You do not need to use a solicitor to deal with the court process but you must ensure the forms and applications are properly completed. If not, you could be liable and have to make a payment from your own money.

    We will assess what forms you require and will provide a checklist of all the details we need from you.

  • Once we have received the completed checklist and payment from you, we will start to prepare the documents you require and advise you of any further information we need.

  • Once we have the full information for you we will complete the forms within 7 days.

  • We will send the completed forms to you along with a covering letter for you to submit to the Court. If there are any issues, we will correct those for you.

  • The Court will grant Confirmation and you can carry on with winding up the estate. You will be able to close any bank accounts and sell any property. Then once you have the funds can pay out the inheritance.

  • Depending on the values of any assets, you may need Confirmation to release bank or investment funds and to sell or transfer property.

  • An Executor needs to be appointed in order to administer the estate.

  • If the estate value is over a certain amount, you may need to pay inheritance tax.

  • Once you have all the values and provided us with all the information, we will complete your forms within 7 days. Depending on the Sheriff Court, you could have the Confirmation document within weeks of submission.

  • This depends on your requirements. Our fees are set so you know from the outset what the cost will be.

  • It is recommended that an Executor should not pay out the estate until 6 months after the date of death to allow any creditors to make a claim, as there might be some debts you are not aware of.

    If there is a Will, it tells you how the estate is to be paid out, subject to legal rights.

    If there is no Will, then the estate is instead dealt with by the law of inheritance, subject to certain rights.

    • the original Executor has died or is unable to act without finalising things; or

    • more assets are discovered, or some assets have been wrongly valued in the original Confirmation
