What is Confirmation?

When someone dies their bank accounts and other assets are usually frozen. Before those left behind can receive their inheritance, a formal process must be followed so that any money can be released and property can be sold or transferred.

When dealing with matters in Scotland you may need Confirmation (called Probate in England) to wind up the estate and pay out the inheritance. This depends on the estate value and whether there is any property.

Confirmation is a formal Court document which gives authority to receive payments of money from banks, building societies, insurances companies etc, and to deal with any house or other possessions which the person owned when they died. A house cannot be sold or transferred without this Court document.

Getting Confirmation must be done by making an Application to the Court to be “confirmed” as an Executor of the estate.

The forms must be completed accurately and in accordance with the Court Rules. If you make a mistake, you as the Executor are legally responsible.
