If you do not have a Will, then when you die it is considered that you have died “intestate” and the law will determine who is to receive what you own. This means that the law decides who inherits instead of you.

Why should I have a Will?

Everyone should have a Will to ensure what you own goes to the people who deserve it.

Also, if you do not have a Will and you are not married, then your partner will not automatically receive anything.

Having a Will means you decide who receives your property, possessions and money after you die.

A Will can make sure that someone who would not inherit by law can receive something. For example, you might want to make sure a stepchild is treated in the same way as any other children you have.

What is a valid Will?

If you live in Scotland (or own property here) it is important that your Will complies with the laws of Scotland for it to be valid.

If you use a Will writing service or a DIY Will kit they may be tailored to the laws of another country (England, for example) where there are different rules around creating a Will and how it should be signed and witnessed. This means it would not automatically be valid in Scotland.
